California has no-fault divorce. This makes it relatively easy to get divorced based solely on a showing of irreconcilable differences. Parties who no longer wish to live together as husband and wife also have the option of filing for legal separation, rather than for dissolution of marriage. Legal separation provides the same financial and custodial options as dissolution without granting a divorce.

Division of Property: What is Really Mine?


California considers most property acquired during the marriage to be community property—which is divided equally. Property obtained prior to a marriage is generally considered separate property. These concepts may seem simple, but California laws regarding property can become complex—especially when assets and debts straddle the line between community and separate estates.

Spousal Support: Will I Receive or Will I Need to Pay Support?


Spousal support, sometimes called alimony, refers to financial maintenance paid to a spouse designed to preserve each party’s economic status during or after the divorce process. The amount of child support divorcing or separating parties will receive or pay can be a top financial concern. In California, child support is determined based on the incomes of each party. When one party is unemployed or underemployed, the court can substitute earning capacity for actual earnings. Either way, the respective incomes or earning capacities determine the actual child support owed under the statewide guidelines.

Every court in the state uses the same set of calculations and formulas to determine the basic, minimum child support to be paid. Other factors—usually based on the specific or special needs of the children—can affect the guideline calculation, however.

Paternity: What About Custody & Support When Parents Are Not Married?


If you and your significant other have not been married, but you have a child or children together, California law provides you with legal remedies regarding child custody and child support—the same as cases involving marriage and divorce.
